Any order that you place on our website will be subject to these general conditions of sale. The purpose of these is to define the sales regime and the rights and obligations arising therefrom.
We inform you that, insofar as you order the products online, your agreement concerning the content of these present general conditions of sale does not require a handwritten signature.
We also invite you to read the version in force on the day of your order.
1. Online ordering: what are the traces of the sale made?
Unless proven otherwise, our computer records, kept under reasonable security conditions, will provide proof of communications, orders and payments.
We will archive purchase orders and invoices for a period of 5 years that can be legally produced as proof.
2. The conditions of the offers: the availability of the products?
Our product offers and prices are valid as long as they are visible on the site, while stocks last.
For products not stored in our warehouses, our offers are valid subject to availability from our suppliers. In this context, indications on the availability of products are provided at the time of placing your order. As this information comes directly from our suppliers, errors or modifications may exceptionally occur.
In the event of unavailability of products not stored after placing your order, we will notify you by e-mail upon receipt of the information transmitted by the suppliers.
3. Product identification: the information provided?
The photographs, texts, graphics, technical data sheets are for the most part taken from documentation produced by the manufacturers or constructors, reproduced under their control and with their agreement.
4. Product marketing: conformity of offers?
The products we offer comply with the legislation and standards applicable to Belgium.
In the particular case where a package does not contain a paper notice in the three national languages, "Cook4pets" undertakes to make this supplement available to you in paper or digital form (PDF document for example), according to our possibilities.
We cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered, it is your responsibility to check with local authorities the possibilities of importing or using the products or services.
5. Information when ordering: information to be provided?
You must check the completeness and conformity of the information you provide to us when ordering, in particular concerning the name, first name, company (if applicable) and the delivery address.
We cannot be held responsible for any data entry errors and the resulting consequences (for example delays or errors in deliveries). In this context, the costs incurred for the reshipment of the order would be at your expense and payable in advance.
6. Means of payment.
To pay for your order, you have all the means of payment offered during the final validation of the order form:
- Bank card.
- Bank transfer.
An order paid by Paypal or credit card (Visa and MasterCard) will be processed immediately.
An order paid by bank transfer will be processed upon receipt of the bank transfer to our bank account. The periods of availability as of dispatch start from the date of registration of the payment.
7. Online payment: what security?
By validating the order form, you guarantee that we have the necessary authorizations to use the payment method you have chosen.
We certify that the bank card details are encrypted using the S.S.L. (Secure Socket Layer), and never pass unencrypted over the Internet. Payment is made directly to the bank. At no time do we have knowledge of your bank card numbers.
8. The payment.
Payment is due in full from the order. The sums collected cannot be considered as a deposit or down payment.
An order will be considered as closed when all the products have been shipped and you have fully paid for the products and your contribution to shipping costs.
9. Incomplete payment: what effects?
We will have the right to refuse to make a delivery or to honor an order in cases where you have not paid in whole or in part a previous order, or in cases where a payment dispute remains.
We retain full ownership of the products for sale, until full collection of all amounts due for your order including taxes and fees.
However, upon receipt of the goods, the burden of risk is transferred to you. You must therefore ensure the proper conservation of these goods.
In the event of resale, the customer undertakes to immediately notify his seller by mail, to enable him to exercise, if necessary, his right to claim the price with regard to the third-party purchaser and to inform the latter of the existence of a retention of title clause.
10. Methods of delivery.
The products will be delivered to the address you indicated on the order form.
Delivery will be made by DPD, with a delay of 48 hours after shipment of the order.
11. Delivery times: when will your products arrive?
The applicable delivery times are 48 hours after the shipment of your order. An order placed before 12 noon of a product in stock will be shipped the same day (excluding weekends and public holidays). We do not partial ship an order.
Note, however, that any order paid by bank transfer will only be processed upon receipt of the bank transfer to our bank account. Both availability and shipping times must be recalculated from the date of registration of this payment method.
12. Late delivery: what to do?
In the event of a delivery delay within five to ten working days following the dispatch date mentioned in the dispatch confirmation e-mail, we invite you to report this delay by contacting our "after-sales" service ...... ..…
We will open an investigation with the carrier concerned to obtain the location of the package. The carrier has 21 days to locate the package.
If the goods are found, they will be redirected as soon as possible. Otherwise and after obtaining the declaration of loss declared by the carrier, we will reship the product (s) or in the event of definitive unavailability, we will reimburse you for the sums collected in accordance with the terms of these general conditions of sale. We will do our best to reimburse you within a maximum of 15 days from the date the carrier's investigation was closed.
It is reminded that no refund or return of the product can be made before the carrier's investigation is closed.
13. What precautions for use, how to react in the event of an anomaly or theft?
We invite you to check (or have the agent who receives them check) the apparent condition of the products upon delivery. In the presence of an apparent anomaly (damaged package, missing product compared to the delivery note, broken products, etc.) you must in this case absolutely refuse the package and issue on the carrier's slip handwritten reserves describing precisely the anomaly. Then contact our "after-sales" service on our website within 48 hours at this address: firstname.lastname@example.org to inform them of your refusal.
In any case, these precautions do not preclude the benefit of legal guarantees and the exercise of the right of withdrawal.
14. You notice a delivery error: what to do?
The products delivered do not conform to the order. In the event of a non-conforming product, you can make your complaints to our "after-sales" service on our website at email@example.com.
You will be asked to describe precisely the reasons justifying the non-compliance.
15. Efficient returns management: assigning a processing number.
We will do our best to rectify the problem you encounter as soon as possible.
To ensure better processing of the return, the efficiency of the diagnosis and the speed of intervention by the manufacturers, a return request must be made directly to our "after-sales service" on our website firstname.lastname@example.org. a return number will then be communicated to you.
16. A complete return of the order: documents + products.
When returning, we recommend that you over-pack the original packaging of your products, as we can only take back products returned in their entirety, all of which must be intact, in good condition and unused.
You must accompany your return with a duplicate of the invoice. Refunds or exchanges assume that you have not damaged the product, or that you have not returned it incomplete.
We especially draw your attention to the fact that you must return the product (s) ensuring full return risk insurance coverage, in relation to the purchase invoice.
17. The duration of the right of withdrawal.
We do not grant you any withdrawal period for perishable goods.
18. Prices: what taxes?
All orders will be invoiced all taxes included (T.T.C.). You will only be entitled to an exemption from the VAT corresponding to the product (s) ordered if you meet the conditions required to benefit from a tax refund, this therefore concerns intra-community purchases;
19. You are an intra-community national: is it possible to recover the VAT?
If you are an individual or an entity not subject to VAT, you will have to pay the prices indicated all taxes included (T.T.C.), participation in shipping costs included where applicable.
If you are an entity subject to VAT (in particular a non-Belgian company located in a State of the European Union), you must send us a request on the letterhead of your company which must explicitly mention the intra-community VAT number. of the company as well as an official document mentioning this intra-community VAT number. 20. Exemption from liability: cases of force majeure.
All facts or circumstances that are irresistible, unforeseeable and beyond the control of the parties are considered as fortuitous or force majeure exonerating liability.
In such circumstances, a rapprochement is to be favored in order to examine the impact of the event and to agree on the conditions under which the execution of the contract will be continued.
